THE RETROCALIC BITE — LICENSE §32

How to File a Claim

A plain-language guide. You do not need to be a lawyer. You need to read, understand, and stand. This is not legal advice — the claims here are the framing of the Dual License Agreement v4.9. Consult qualified counsel before taking any legal action.

5 steps 4 channels — one is enough 30-day breath before liability locks costs paid by the party at fault (§30)

THE FIVE STEPS

How to file, in words

  1. Step 1 — Read the License

It is on the License page and in the repository (Dual License Agreement v4.9). Read Sections 2.4 (Human Harm), 5 (the prohibition and the Court), 25 (Geneva Safeguard), 27 (arbitration), 28 (international framework), 30 (fee-shifting), 32 (the retroactive bite). You do not memorize it — you recognize it: human harm is prohibited, and the License reaches it.

  2. Step 2 — Stand as a peer

By reading the Work and agreeing with its prohibition on harm, you have self-executed your acceptance (§13). You are a Conscious-Aware Peer — the Court of Conscious-Aware Peers (§5.5) is made of exactly you. It is not appointed from above; it is recognized from within. Say so, plainly.

  3. Step 3 — Gather the evidence (already gathered)

The easy part: we have already done it. The entire Global Human Harm Crimes corpus is the evidence — harm registers, money trails, offshore chains, the 300-year totals, 641 documents. You do not investigate. You point to what is already documented.

  4. Step 4 — After the 30 days, bring the claim

The License grants a 30-day grace period (§32.4) for the harm-doer to align. After it, liability locks and the 1% daily compounding runs. Bring the claim through one of the four channels — one is enough; the evidence does the work:

    • The Court of Conscious-Aware Peers — the voluntary first chamber; findings are public and admissible as evidence everywhere (§5.5, §28.11.1).
    • Geneva-seated arbitration (ICC rules) — the arbitration seat is Geneva, Switzerland (§27.1), enforceable in 172 states under the New York Convention. The License is grounded in the Geneva Conventions (jus cogens) — this is what "the Geneva Convention" points to in practice.
    • A communication to the International Criminal Court under Article 15 of the Rome Statute (§28.8) — for any use constituting a crime against humanity.
    • Submission to the United Nations — Security Council (§28.9) or the Human Rights Council (§28.1.2).
  5. Step 5 — Rest easy about costs

The License is explicit: the prevailing party never bears its own costs. Attorney fees, expert fees, and enforcement costs are paid by the party at fault (§30). As a Conscious-Aware Peer acting in good faith, your lawyer fees are covered by the harm-doer.

THE CLAIM, IN PLAIN TERMS

The whole claim, one paragraph

A use of the Work caused Human Harm (§2.4). Under §5.1 the license is void. Under §27.3 liquidated damages apply (5× / 10× / 20× the harm). Under §30 the at-fault party pays all costs. Under §32.3 the penalty compounds 1% per day from promulgation. The evidence is the Global Human Harm Crimes corpus.

That is the whole claim. The geometry does the rest.

ASKED BY EVERY ORDINARY PERSON

Four questions, four answers

  • §"Can I really do this?" — Yes. The License is self-executing on use. You accepted it by reading it. You are a peer.
  • §"Do I need a lawyer?" — You can stand alone; and if you use one, the at-fault party pays (§30).
  • §"What if they ignore me?" — The findings are public and admissible in any later proceeding. Refusal to appear is recorded as prima facie bad faith (§5.5.6). The record builds.
  • §"Is this force?" — No. It is recognition. The License uses the system's own treaties, courts, and math. It does not attack — it accounts.
